Terms and Conditions for the Customer and the Service Operator.

- Customer Terms and Conditions :
1- The Customer acknowledges, upon receiving the Service, their full acceptance of the liability terms and conditions set forth herein.
2- All parked vehicles shall be under the responsibility of the Service Operator.
3- The Customer acknowledges that the VIP Parking system is a technical platform that provides service organization only and bears no responsibility between the Customer
and the Service Operator for any damage to vehicles or any harm suffered by the Customer. Full responsibility shall rest solely with the Service Operator.
4- The Service Operator shall not be liable for any damage resulting from brake failure or any mechanical, electrical, or technical malfunction of the vehicle,
unless such damage results from gross negligence or willful misconduct by the Service Operator.
5- Any accident involving the vehicle shall be handled through insurance companies, unless the Customer elects to repair the vehicle with another party.
In such case, the vehicle owner shall be compensated for the repair cost after approval by the insurance company, and the compensation amount shall be determined solely based on the insurance company’s assessment. (Between the Service Operator and the Customer)
6- In the event of an accident involving the Customer’s vehicle, the Service Operator is not obligated to provide a replacement vehicle.
7- If the vehicle is leased, the Service Operator shall not bear any cost for renting a replacement vehicle, nor the rental fees during the repair period, and communication regarding the accident shall be limited to the direct Customer only.
8- The Service Operator shall not be responsible for any items or personal belongings left inside the vehicle.
9- The Customer must settle all financial dues before receiving the vehicle from the service location.
10- The Service Operator shall not be liable for any delay or damage resulting from circumstances beyond control, such as natural disasters or public accidents.
11- The Customer must submit any complaint or claim within a period not exceeding forty-eight (48) hours from receiving the vehicle. If no complaint is submitted within this period, the service shall be deemed accepted. (Service Operator complaint number)
12 - The Customer agrees, to the extent permitted by law, to fully indemnify and hold Darriyah Company vip parking from any and all liabilities, claims, causes of action, damages, and expenses (including attorney’s fees) arising from any breach of these Terms or any unlawful or improper use of the Service.
13- In the event of any conflict or discrepancy in any provision or interpretation between the Arabic and English versions, the Arabic version shall prevail and be the governing version.
14- These terms and conditions shall be governed by the laws of the Kingdom of Saudi Arabia, and jurisdiction shall lie with the competent courts within the Kingdom.
- Service Operator Terms and Conditions :
15- By using the VIP Parking platform to provide technical valet parking services, the Service Operator acknowledges full acceptance of these terms and conditions.
16- The VIP Parking platform operates solely as a technical platform to organize and facilitate services and does not provide operational services itself, nor does it bear any responsibility for damages resulting from operational services. Full responsibility shall rest with the Service Operator.
17- The Service Operator shall perform the operational services with high quality in accordance with Saudi legal and professional standards.
18- The Service Operator shall maintain the validity of all required licenses, permits, and necessary insurance coverage.
19- The Service Operator shall be responsible for dealing with Customers and managing any claims or incidents.
20- The Service Operator shall be responsible for any damage resulting from the operational services.
21- All claims arising from accidents or damages shall be handled between the Service Operator, Customers, and the relevant insurance companies, noting that the VIP Parking platform is not a party to such claims.
22- If the vehicle is leased, neither the Service Operator nor the VIP Parking platform shall bear any cost for renting a replacement vehicle or the vehicle rental fees during the repair period.
23- Communication regarding any accident shall be limited to the direct Customer and the Service Operator.
24- The Service Operator shall be obligated to pay all fees or commissions due to the VIP Parking platform in accordance with the agreement.
25- The Service Operator and the VIP Parking platform shall be committed to protecting customer data and operational data and shall not disclose such data to any third party in accordance with the laws of the Kingdom.
26- The Service Operator shall bear full responsibility for the drivers and employees performing the service on its behalf, including legality of employment, validity of residencies, licenses, and other legal documents. Any deficiency or failure, whether intentional or unintentional, shall be borne entirely by the Service Operator.
27- In the event of any conflict or discrepancy in any provision or interpretation between the Arabic and English versions, the Arabic version shall prevail and be the governing version.
28- The Operator agrees, to the extent permitted by law, to fully indemnify and hold Darriyah platform vip parking from any and all liabilities, claims, causes of action, damages, and expenses (including attorney’s fees) arising from any breach of this Agreement by the Operator or its employees or representatives.
29- do not guarantee that our website, or any content on it, will be continuously available or uninterrupted. We may also terminate or suspend access to all or any part of our website immediately, without prior notice or liability, for any reason whatsoever.
30- These terms and conditions shall be governed by the laws of the Kingdom of Saudi Arabia, and jurisdiction shall lie with the competent courts within the Kingdom.
